Q. What is Probate and How Long Does it take?

Probate occurs when a person dies and has property that survives them. Whether they have a will or not, the estate has to be liquidated. This probate process can be long and painful.

Many estates are tied up in probate for long periods of time.   During this time the personal representative is responsible for paying all of the bills and debts associated with the estate.  In many instances the personal representative needs to sell assets of the estate to pay creditors in order close the estate.

Yes, in an informal probate the personal representative can enter into contracts to sell assets in the estate.  In formal, or supervised probates the personal representative will need to get permission from the court to sell any assets of the estate.
